Hispanic man shove an Asian undercover cop on Queens subway, is released without bail

Anti-racist bail reforms work as intended!



The man charged with attempting to smuggle an Asian undercover cop onto Queens subway tracks was released without bail Sunday, claiming that the judge's hands are bound.

Ricardo Hernandez, 32, is charged with three counts of hate crime in connection with the assault on the unidentified cop on a Long Island City train platform around 5:30 p.m. Saturday. Hernandez has at least 12 previous convictions.

At Hernandez's arraignment for the alleged drive into the tracks, Queens Supreme Court Justice Louis Nock claimed that he could not keep Hernandez in jail due to the state's bail reform initiatives.

"My hands are tied because, under the new bail law, I lack the jurisdiction or authority to set bail on this defendant for this alleged offense", the judge said.

In New York, under new legislation passed last year, assaults that cause no bodily harm are not subject to bail.

Hernandez allegedly approached the undercover cop on the N train platform in Dutch Kills at 31st Street and 39th Avenue and attempted to shove him onto the tracks.

Hernandez reportedly snarled, "That is why you people are being beaten up". "I have nothing to lose. "I am going to f–k you up!" According to police, Hernandez said. "This is my residence".
